TERMS & CONDITIONS for all Corporate Photography and Images supplied to any Service Providers for advertising & promotions
All images on this website are protected under international copyright laws.
Copyright
The copyright in the photographs is owned by and retained by Dawne Fahey (the photographer) at all times throughout the world. The Client agrees that Dawne Fahey is the sole author of the photographs. The client may use the images supplied in their promotional material, but Dawne Fahey cannot and will not guarantee the quality of prints made outside of the Photography Studio.
License to use
Photographs or images are not to be used before payment in full of the relevant invoice(s).
Photographers promotional use
Dawne Fahey will at all times retain the right to use the photographs in any manner and in any part of the world for the purpose of advertising and promotional purposes, regardless of whether a formal contract/ work agreement has been signed.
Ownership of materials
Title to all Photographs remains the property of Dawne Fahey and her photographic studio.
No Alteration
The image may not be altered or manipulated without the permission of the photographer, Dawne Fahey
Payment
Payment by the client will be required for the right to use the photograph/s or image/s as provided within 7 days of the issue of the relevant invoice.
Indemnity
The photographer shall not be liable for any legal action, claim or damages resulting from or arising out of the publication of the photographs or other use by the client. The client shall indemnify the photographer, Dawne Fahey, and/ or their assistant, against any claims and/or damages against them as a result of the clients use of the photographs.
Right to a credit
When applicable Dawne Fahey’s name will be printed in reasonable proximity to all published reproductions of the photographs unless agreed otherwise.
Client Confidentiality
The Photographer will keep confidential and will not disclose to any third parties or make use of material or information communicated to them in confidence for the purposes of the photography save as may be reasonably necessary to enable her/them to carry out the work.
Variation
These terms shall not be varied except by agreement in writing.
Applicable Law
This agreement is governed by the Laws of New South Wales
